In order to inquire about opening a Business account you may contact our toll free customer service line during normal Business hours at 1-888-346-6524, Monday through Friday, 10:00AM to 6:00PM EST, you may also email your inquiry to firstname.lastname@example.org, fax your inquiry to 305-402-2300, or apply online at wholesale.cfm. In order to apply online you must first setup a SouthSmoke.com account only at www.southsmoke.com/signup.cfm. When submitting an inquiry by email or fax, please be sure provide your complete name, Business name, location of your Business, Business email address, phone and fax numbers, the duration of time your Business has been in existence along with a copy of your applicable sales tax licensing, tobacco licensing (if you intend to purchase and resell tobacco), and other applicable licensing as per your jurisdictions requirements. Upon receipt, review, and verification of the above-referenced information, our experienced account representatives will contact you within a reasonable time thereafter to discuss your inquiry and proceed accordingly. We do appreciate your patience during the inquiry process as we do receive numerous inquiries on a daily basis and process them in the order they are received. Be aware that if you fail to provide all the information we require during your initial inquiry, this will inevitably delay your ability to proceed to open a Business account with our company and your inquiry may lose its place in our queue. Global Hookah, Inc. is unable to take any action until we have your complete Business information and applicable licensing on file and have verified the same with your governing jurisdiction(s), thus it is your responsibility to furnish all required information to our company. Once your Business is registered with our company and all information and licensing is on file, your Business will receive its unique confidential pricing schedule for the applicable Tobacco, Non-Tobacco, and related Hookah products and accessories. Be aware that your Business custom pricing schedule is subject to our strict confidentiality and non-disclosure agreement (See Paragraph 8 below) and that any unauthorized disclosure to any unauthorized party shall cause your Business to incur a substantial penalty as outlined in our Liquidated Damages Clause below. This includes any emails we exchange with you, quotations, estimates, invoices, and all other communications by us to you regarding pricing. At this point, your Business may place an order via telephone at 1-888-346-6524, Monday through Friday, 10:00AM to 6:00PM EST, email your order to email@example.com, or fax your order to 305-402-2300.
Online Portal Access
In addition to telephone, email and fax orders, Global Hookah, Inc., provides our Business clientele the enhanced ability to place their order(s) online through our account portal at www.GlobalHookah.com. Global Hookah, Inc. is effectively able to simplify the entire ordering process through its online account portal and encourages our Business clientele to utilize this unique account feature. If you wish to obtain access to our online account portal and review the benefits we are able to provide you in doing so, please advise your account representative. You will first be required to obtain your Business login credentials from your account representative in order to access GlobalHookah.coms online order portal as well as undergo the required tutorial with your account representative who will walk you through the ordering portal features, ordering procedures, and address any questions you may have regarding the same. Be aware that both the login credentials and tutorial are performed simultaneously. We understand your time is valuable and the entire process should take approximately 15 to 20 minutes of your time to complete. Your time is certainly worth taking as the online ordering portal will enhance your experience by providing you with various features that are guaranteed to streamline the entire ordering process as well as your overall Business experience with our company. Be aware that our online portal is only accessible through your tablet device, laptop, personal computer or Mac and cannot be properly accessed over mobile devices so you will need to have either your tablet device, laptop, personal computer or Mac available to be able to efficiently complete this process. Once you have obtained the necessary training in order to effectively navigate the Online Portal, it is your responsibility for training any additional authorized users at your Business. Be forewarned that if you authorize any employee of your Business to access your Online Portal, that employee/those employees will then have access to your Business unique custom pricing and shall be subject to the Global Hookah, Inc. strict Confidentiality Policy (Paragraph 8 below). Choose your authorized users carefully as you and your Business are fully responsible for any violation of the Global Hookah, Inc. strict Confidentiality Policy. Be advised that not all Business clientele are eligible for Online Portal Access and Global Hookah, Inc. may, in its sole discretion, permit, suspend, and/or terminate your Business portal access at any time for cause and without cause.
Global Hookah, Inc. currently accepts the following payment methods: Credit/Debit Card: Visa, MasterCard, American Express & Discover. Global Hookah, Inc. also accepts alternative payment options including: ACH Debit from your Business checking or savings account, Business checks, wire transfers, money orders and for approved Businesses, credit terms. Be advised that you are responsible for any and all fees associated with the use of your credit/debit card and financial/banking institution for insufficient funds (NSF), overdrafts, dishonored checks. Global Hookah, Inc. shall not be liable for any fees associated with your authorized method of payment. It is your responsibility prior to providing your desired method of payment to verify your funds are in fact available to satisfy the costs of your order. In the event that Global Hookah, Inc. incurs any charge(s) as a result of your failed method of payment, you are responsible for reimbursing Global Hookah, Inc. within (48) hours of being notified of the payment failure and fee incurred. Your failure to keep your account with Global Hookah, Inc. current and in good standing by satisfying any outstanding balance and or fees incurred for payment failure(s) will result in the suspension of your Business account. In the event you fail to resolve any outstanding balances incurred for payment failure(s), you acknowledge and agree that your Business and the personal guarantor associated with your Business account shall be liable to resolve the same as well as any collection fees, legal fees, costs and/or expenses incurred by Global Hookah, Inc. in its pursuit of the collection of your delinquent account.
In the event of a chargeback or non-payment against Global Hookah, Inc. the Business account holder and personal guarantor shall be responsible for all fees regarding collections. These fees include, but are not limited to, the North Carolina Service charge, $30 chargeback fee issued by the credit/debit card issuer, all applicable collection agency fees incurred by Global Hookah, Inc., all attorney fees and legal costs incurred, original shipping charges incurred by Global Hookah, Inc., return shipping charges incurred by Global Hookah, Inc., and any other fee(s) imposed. In the event of non-payment, the Business and personal guarantor shall be responsible for the costs of the merchandise at the time of order.
If you are making payment via Credit/Debit card, your card account statement will reflect the grand total of this invoice and will appear under the name Global Hookah, Inc. If you are making payment via Credit/Debit card, you may notice that the amount reflected on your online card account statement is higher or different than the grand total listed on the invoice that is attached to this email. This is normal as your card is pre-authorized prior to submitting your order for processing and shipping. Once the shipping rate is calculated and the grand total of your invoice is determined, the pre-authorized amount will be forced through at the grand total that appears on the invoice that is attached to this email. The remaining overage, if any, will drop off your online card account statement and change to reflect the grand total of this invoice. If you made changes or modifications to your order prior to shipping, your online card account statement may show more than one transaction for this invoice. Typically, if you add up the amounts billed to your card account, it should reflect the grand total as listed on the attached invoice.
All Business Accounts shall require an authorized person to serve in their personal capacity as a guarantor for the Business Account. This personal guarantee shall remain in full force and effect and survives any declared Bankruptcy or application for Bankruptcy protections for your Business.
Global Hookah, Inc. now has the unique ability to extend its approved Business clientele credit terms. Businesses may apply for credit terms by completing a credit application and paying an application fee of $59.00. If approved, the $59.00 application fee shall be credited toward your Business? first order with our company. In the event your application is denied, then the $59.00 shall be applied toward your first order using an alternate method of payment. Businesses applying for Credit Terms shall be required to list at a minimum, (2) two separate authorized secondary payment sources, whether utilizing a financial institution checking and/or savings account(s) and/or Debit/Credit Card(s) in the event of non-payment under the Credit Terms extended as a safeguard to assure payment to Global Hookah, Inc. of any credit balance which becomes overdue. All Business Accounts shall require an authorized person to serve in their personal capacity as a guarantor for the Business account and any debts incurred which become overdue as defined herein. The Business(es)/Individual(s) who have provided and authorized the secondary payment sources hereby gives full and unfettered authorization for Global Hookah, Inc. to charge these secondary payment sources in the event the Business(es) lapse in payment and fail to correct the deficiency within (7) seven consecutive days from the date payment was otherwise due under the Credit Terms extended. Global Hookah, Inc. is then authorized to charge the secondary payment methods at the end of the (7) seven day period as previously authorized in order to satisfy the outstanding balance(s) owed by the Business at issue. In the unlikely event the secondary payment methods fail to resolve the overdue balance of the Business(es), the Personal Guarantor(s) listed shall be immediately notified and have (5) five consecutive days to resolve the overdue balance and any fees incurred for failure of payment under the Credit Terms extended to the Business(es) at issue. Further, Global Hookah, Inc. shall also require a Personal Guarantor who agrees to be personally liable for an overdue Business account which has failed to make timely payment(s) on its account under the Credit Terms extended and whose secondary methods of payments have since failed to resolve the overdue balance in full. Please be advised that Global Hookah, Inc. does require a minimum purchase of $2,000.00 to extend credit terms to your Business or that your Business maintain a minimum balance of $2,000.00 at all times while exercising your entitlement to utilize credit terms with Global Hookah, Inc. Your Business is required to make an initial payment of 10% down and the remaining 90% balance must be paid in full within the time period set forth on your credit terms from your invoice date. In the event your account is not paid in full within the time period granted, then your account balance shall be immediately due and payable in full to avoid suspension and shall include an additional 15% penalty applied to the current balance due in full to resolve your delinquency. Your failure to keep your account with Global Hookah, Inc. current and in good standing by satisfying any outstanding balance and or fees incurred for payment failure(s) will result in the suspension of your Business account. In the event you fail to resolve any outstanding balances incurred for payment failure(s), you acknowledge and agree that your Business and the personal guarantor associated with your Business account shall be liable to resolve the same as well as any collection fees, legal fees, costs and/or expenses incurred by Global Hookah, Inc. in its pursuit of the collection of your delinquent account. You and your Business are responsible for ensuring all information contained within the Credit Application, Primary and Secondary Payment Authorizations, and the Personal Guarantor(s) is/are current. Your failure to do so may result in the suspension of your Credit Terms, your Business Account, and/or a delay in any order being processed and shipped to your Business.
DISCLAIMER AND LIMITATION OF LIABILITY AS TO PRODUCTS SOLD AT GLOBALHOOKAH.COM:
All of the Global Hookah, Inc. products are guaranteed against defects for (72) seventy two hours from the date that the recipient receives the merchandise, but not to exceed seven (7) Business days. Business days are defined as Monday through Friday. By ordering from Global Hookah, Inc., you agree and certify under penalty of perjury and as per State and Federal guidelines that you are at least 21 years of age or older, and able to purchase Tobacco and/or Tobacco related Products and/or Accessories in your state. By ordering from Global Hookah, Inc., you also agree that Global Hookah, Inc. has up to 14 Business days to ship your merchandise out of our facilities. Once an order has been shipped and/or tracking information has been received from FedEx, UPS, USPS, or Freight LTL/FTL/Container, a customer cannot cancel and/or refuse delivery on their order without prior consent from Global Hookah, Inc. via email or US Mail. Global Hookah, Inc. reserves the right to charge a fifteen (15%) percent restocking fee on any order returned to our company after final inspections. Global Hookah, Inc. also reserves the right to charge any applicable fees that may have been associated with the order at the time of shipping if merchandise is returned to our facilities. Any merchandise returned to our facilities must be unused and in all original packaging and in the condition that you received it in. Any merchandise deemed used will be refused by Global Hookah, Inc. and will be returned to the customer at the customer's expense. If a Return Merchandise Authorization (RMA) was issued by Global Hookah, Inc., the customer is responsible for paying the return fees associated with the UPS/USPS/FedEx standard rates guide if the merchandise is deemed used, not in its original condition, or is returned because the customer was not satisfied with the merchandise and Global Hookah, Inc. has concluded that there is nothing wrong with the merchandise received back in our facilities. Global Hookah, Inc., except as expressly stated herein, makes no representations or warranties, either express or implied, of any kind with respect to products sold on the GlobalHookah.com website. Except as expressly stated herein, Global Hookah, Inc. expressly disclaims all warranties, express or implied, of any kind with respect to products sold on this site, including but not limited to, merchantability and fitness for a particular purpose. You agree that the sole and exclusive maximum liability to Global Hookah, Inc. arising from any product sold on the GlobalHookah.com sites shall be the price of the product ordered. BUSINESS PRICING, TERMS, CONFIDENTIALITY & LIQUIDATED DAMAGES:
Global Hookah, Inc. is able to offer its Business customers custom pricing schedules based on various proprietary factors and our extensive tobacco licensing placing our Business customers in a stark competitive advantage to other Businesses dealing in the Hookah industry. In order to maintain this advantage, Global Hookah, Inc. pricing schedules and lists are password protected, subject to the strictest of confidences and are not openly published, distributed, advertised or available to the public domain at large. As such, you hereby acknowledge that Global Hookah, Inc., by creating a unique pricing schedule for your Business and providing you disclosure of the same, you agree to not publish, distribute, advertise or otherwise make available your Business pricing nor re-disclose the pricing you are provided to any third party. You hereby acknowledge and agree that this unique pricing schedule is confidential, you hereby agree to use all reasonable measures to safeguard this information from disclosure of any kind once you are privilege to this confidential information, and you agree to be bound by our Terms of Service regarding the confidentiality of the custom pricing schedule we have created for your Business. Be forewarned that if you authorize any employee of your Business to access your Online Portal and/or otherwise access your custom Business pricing schedule/list, that employee/those employees will then have access to your Business unique custom pricing and shall be subject to the Global Hookah, Inc. strict Confidentiality Policy (Paragraph 8 below). Choose your authorized users carefully as you and your Business are fully responsible for any violation of the Global Hookah, Inc. strict Confidentiality Policy. You further acknowledge and agree that any misappropriation of confidential pricing information in violation of Global Hookah, Inc. Terms of Service will cause Global Hookah, Inc. irreparable harm, the amount of which may be difficult to ascertain, and therefore you agree that Global Hookah, Inc. shall have the right to apply to a court of competent jurisdiction for an order enjoining any such further misappropriation and for such other relief as Global Hookah, Inc. deems appropriate. This right is to be in addition to the remedies otherwise available to Global Hookah, Inc. As a violation of Global Hookah, Inc. Terms of Service with respect to its confidential Business customer pricing schedule is otherwise speculative and/or difficult to ascertain, any violation shall result in a monetary penalty in the amount of $100,000.00 liquidated damages. This amount is agreed by you to be a reasonable estimate of the probable harm caused to Global Hookah, Inc. or is otherwise deemed by you to be reasonably proportionate to the damages actually caused by the breach. You further agree to indemnify Global Hookah, Inc. against any and all losses, damages, claims or expenses incurred or suffered by them as a result of your breach of Global Hookah, Inc. Terms of Service regarding confidential Business customer pricing schedule. In any dispute arising out of or related to this liquidated damages clause and the confidential Business customer pricing schedule, the prevailing party shall have the right to collect from the other party its reasonable attorney fees and costs and necessary expenditures with respect to their enforcement of the same.
INTERNATIONAL BUSINESS ORDERS:
Global Hookah, Inc. is happy to engage with international Businesses and coordinate the shipping of our Tobacco and Tobacco related products and accessories outside the United States to most countries. Due to existing regulations, it is important to immediately note that all sales of tobacco to Businesses are final and not subject to return or exchange. It is very important that you understand that under no circumstances shall your Business sell merchandise that it purchases from Global Hookah, Inc. to the United States Marketplace and that all international orders are exclusively limited to sale to other international countries outside of the United States. Under no circumstances shall any products purchased and shipped internationally be sold and delivered into the United States. Please understand that for deliveries to international destinations outside the United States your Business will be required to set up freight forwarding services. It will be your responsibility to coordinate with a freight forwarding service and provide our company with accurate information on the freight forwarding service so your order may be timely delivered to the appropriate freight forwarder to avoid any unnecessary delay. Further, due to International regulations, Global Hookah, Inc. may refuse service on International Business orders and reserves the right to do so at any time with any country. Only one International order may be in transit at any given time. Please wait until your current order in transit is delivered prior to placing a new order. We reserve the right to hold a new order placed while an existing order is still in transit to its destination and yet to confirm as delivered.
Please be aware that our quotes for shipping outside the United States and Puerto Rico do not include any applicable duty, value added taxes (VAT), or import consumption taxes. You will be required to pay the duty or VAT upon delivery of your merchandise. Due to import duty valuation adjustments and currency valuations, we are unable to provide an estimate for duty or VAT.
Global Hookah, Inc. shall utilize the United Parcel Service (UPS) or Freight LTL and FTL services to coordinate the shipment of your order from our facilities to your freight forwarding service in the United States.
TAXES, DUTIES, IMPORT FEES, RECORD KEEPING & LICENSING:
Global Hookah, Inc. prides itself on compliance as we are a multinational company serving both the domestic and international business communities. Global Hookah, Inc. Business customers are responsible for the payment of all applicable sales taxes, customs duties, import consumption taxes, value added taxes (VAT), Tobacco Taxes, and similar taxes or fees (collectively, Taxes and Fees) imposed by your country, any government entity (Federal/State/Local) or other collection agency. You will be required to pay any assessed Taxes and Fees upon delivery of your merchandise. Due to import duty valuation adjustments and currency valuations, we are unable to provide an estimate for duty or VAT. Each customer shall be solely responsible for all sales taxes, tobacco taxes, or other taxes, on orders shipped to any other state other than the State of North Carolina. Be advised that the State of Massachusetts requires prepayment of sales tax on Tobacco sales unless your Business is licensed to resell Tobacco to retail stores or other distributors within the State of Massachusetts or outside the State of Massachusetts and your Business possesses the proper credentials and has provided the same to our company.
All Tobacco sales are final and not subject to return or exchange. Global Hookah, Inc. shall not be responsible for expiring Tobacco nor are we able to honor returns or exchanges in order to replace the same. We strongly recommend monitoring your Tobacco inventory at all times and utilizing a "First in First Out? (FIFO) system to properly rotate your inventory to avoid expiring product. Global Hookah, Inc.is currently licensed in (23) States with plans to expand into additional markets in the foreseeable future as demand arises and is necessary to serve our domestic Business clientele. This means that Global Hookah, Inc. will, unless otherwise directed by our Business customer and allowed by law, provide a tax paid service on all Tobacco purchased and shipped into the (23) states we are licensed under. In the event our Business customer decides to opt out of this tax paid service, that Business shall be responsible for all applicable taxes imposed on Tobacco as per their governing jurisdiction. When a Business opts out of being provided a tax paid service by Global Hookah, Inc. on the sale of Tobacco, that Business acknowledges its responsibility to follow the governing law of their jurisdiction, to pay all applicable taxes associated with their purchase of Tobacco, and to agree to hold Global Hookah, Inc. harmless and indemnify Global Hookah, Inc. in the event legal action is taken by any jurisdiction against Global Hookah, Inc. related to a Business customer who expressly opts out of a tax paid service and chooses to assume responsibility for the obligation and payment of all Tobacco taxes relevant to their governing jurisdiction. Global Hookah, Inc. shall not be responsible if its Business customer has opted out of a tax paid service. All opt outs shall be made expressly in writing and shall be preserved by the applicable Business for a minimum of (7) seven years following the purchase of the applicable Tobacco at issue.
Global Hookah, Inc., in providing a tax paid service to its Business customers in the states it is currently licensed in as listed below, does employ and consult with internal and outside legal counsel and takes all reasonable measures to confirm the laws/regulations providing for the Tobacco tax liability formula for the applicable jurisdiction(s) your Business(es) operate(s) within. We do so in order to ensure the accuracy of the tax liability we report and the payment we remit on your Business behalf to your applicable governing jurisdiction for the Tobacco you have purchased from our company. In the event of an audit, the applicable jurisdiction(s) your Business(es) operate(s) within may confirm additional Tobacco tax liability is owed and due along with any applicable penalty and interest creating additional exposure to your Business which your Business is responsible for paying. As stated, Global Hookah, Inc. takes all reasonable measures to confirm your Business tax liability; however, your Business remains responsible for the payment of any additional tax liability assessed on your Tobacco purchase along with any penalty and interest assessed by your governing jurisdiction. Global Hookah, Inc. is not responsible for the payment of any additional Tobacco tax liability, penalties or interest and your Business hereby acknowledges this and agrees to hold Global Hookah, Inc. harmless in the event your governing jurisdiction determines additional Tobacco tax liability is owed. In the event Global Hookah, Inc. provides your Business(es) notice that additional taxes are due, we shall include with such notice the amount due and documentation reflecting the basis for the additional amount due as well as payment instructions to satisfy the amount due. Upon receipt of our notice that additional Tobacco tax is due, your Business shall have (5) Business days to remit payment to the applicable jurisdiction to satisfy the amount due. You agree that you shall provide Global Hookah, Inc. with written proof of payment and satisfaction demonstrating that the matter is resolved with the applicable jurisdiction. In the event Global Hookah, Inc. is required to remit payment on behalf of your Business due to your failure to do so after having been notified and provided written proof and demand for payment by Global Hookah, Inc. to your Business in order avoid any negative action by the applicable jurisdiction at issue, then you acknowledge, agree and authorize Global Hookah, Inc. to resolve the same and that your Business shall be liable to Global Hookah, Inc. for the amount due along with any applicable penalty and/or interest that has since accrued. In the unlikely event that Global Hookah, Inc. is required to retain legal counsel or utilize the services of legal counsel to resolve the additional Tobacco tax liability owed and for which you have failed to issue payment for and resolve with the applicable jurisdiction after having been notified in writing by Global Hookah, Inc. or you have failed to reimburse Global Hookah, Inc. when it has exercised its discretion to resolve the outstanding Tobacco tax liability on behalf of your Business, your Business acknowledges and agrees that it shall be liable to Global Hookah, Inc. for any attorney fees, costs and expenses it incurs.
Global Hookah, Inc. is currently licensed in the following states: Arkansas, Colorado, Florida, Georgia, Illinois, Indiana, Kansas, Kentucky, Maryland, Massachusetts, Michigan, Missouri, New York, North Carolina, Ohio, Oklahoma, Oregon, Pennsylvania, South Carolina, Tennessee, Utah, Virginia, Wisconsin, and Wyoming. Record Retention Requirement
Be advised that all records invoices evidencing your transaction with Global Hookah, Inc. for the sale of Tobacco are dispatched at the time your Tobacco is shipped and must be retained for (7) seven years from the date of the invoice. It is your responsibility to retain such records in accordance with your governing jurisdictions record retention laws with respect to the purchase of Tobacco. In the event you require additional/replacement copies of invoices from Global Hookah, Inc. evidencing your Business past Tobacco purchases, we reserve the right in our discretion, to charge a reasonable service fee for records research and retrieval.
In order to qualify for a Business account and remain in good standing with Global Hookah, Inc., your Business must furnish and maintain its current applicable licensing (Tobacco Tax Certificate/License, and/or Sales Tax Certificate/License, or other required licensing) as per your Business governing jurisdiction(s) it operates within on file with Global Hookah, Inc. at all times. Your Business is responsible for furnishing and maintaining all subsequent licensing renewals and transmitting the same to Global Hookah, Inc. in order to keep your account in good standing and avoid any delays in ordering. In the event your applicable licensing on file with Global Hookah, Inc. has since expired, your account will be suspended and you will not be able to place an order with Global Hookah, Inc. until you furnish current licensing demonstrating that you are current and in good standing with your applicable governing jurisdiction. If you maintain portal access online through our website at GlobalHookah.com, your access will be suspended as well until you correct any deficiencies with respect to your required licensing. It is your responsibility to maintain current licensing in good standing with your jurisdiction and Global Hookah, Inc. shall not be responsible for notifying you if licensing has lapsed and/or expired. As a courtesy and in its sole discretion, Global Hookah, Inc., may notify you if it discovers that your licensing has lapsed/expired and you have recently placed an order during that time to avoid delays in processing and shipping your order to your Business.
SHIPPING RATES, SHIPPING CARRIERS & ESTIMATED TRANSIT TIMES:
At Global Hookah, Inc., we understand how important it is that your Hookah, Tobacco and Tobacco products and accessories arrive on time in perfect condition. Global Hookah, Inc. typically are processed within (24) hours from receipt unless an issue arises which would otherwise delay the order. Global Hookah, Inc. offers the fastest fulfillment times in the industry once your order is processed. Below, you'll find answers to common questions about our shipping rates and policies. Please be aware that cargo claims terms of service are Free on Board (FOB) Origin Dock which means that all purchases of physical items from SouthSmoke.com are made pursuant to a shipment contract and the terms stated below. This means that the risk of loss and title for such items pass to you, the Business customer, once your order is placed in the possession of the applicable shipping carrier. Global Hookah, Inc. assumes no liability for an order that is lost in transit once placed in the possession of the applicable shipping carrier. As a courtesy, the Global Hookah, Inc. customer service team will gladly assist you in attempting to resolve your issue with the applicable carrier; however, we shall not be responsible for any chargebacks for loss of merchandise in transit as your claim needs to be made directly with the applicable shipping carrier, which we will gladly assist you with. In the event your order has been lost in transit you may either contact our customer service team during our normal Business hours, Monday-Friday, 10:00 am - 6:00 pm EST or by submitting an online support ticket to our customer service center at email@example.com. Please be sure to include your Business name and order # for ease of reference and to avoid delays in providing assistance to you.
United Parcel Service (UPS) Shipping Services
Global Hookah, Inc. provides its Business customers with white glove service with the options to ship with the United Parcel Service (UPS) which typically offers guaranteed transit times to your Business destination, be it Ground or Express Services, 3-Day Express, 2-Day Express, or Overnight Express. Express services can include a Saturday Delivery option for an added expense if we are properly given reasonable advanced notice in order to accommodate this special service. In the vent you desire to setup a Saturday delivery service and we are able to accommodate you it is critical we are immediately given notice of this need at the time you place your order with our company. Be aware that during holiday season, November through December, UPS transit time guarantees are inapplicable due to the high volume of shipments UPS encounters. Transit times are calculated by Business days and do not include any applicable holidays where UPS services are otherwise unavailable. Shipping rates with UPS are based on the size of the shipment, weight of the shipment, dimensional factors, and your Business location. Please note that shipping Business orders to residential and rural addresses will typically incur a higher rate than shipping Business to Business. Please remember to verify the accuracy of your shipping information along with any special services you may require. It is your responsibility to be available to receive your shipment to your Business regardless of your operating hours. We will do our best to accommodate you within the permissible guidelines of the shipping carrier utilized. Your failure to provide accurate shipping information and advance notice and confirmation of any special requests will inevitably cause a delivery exception resulting in the delay of your shipment or even the return of your shipment to our facility. You are responsible for any address correction fees, intercept fees, re-direct fees, signature fees, as well as any other losses as a result of your failure to provide accurate information for your Business. It is your responsibility to monitor the tracking for your merchandise while it is in transit to your Business and to be present at your place of Business to receive your shipment to avoid delay, return, and the imposition of any additional fees associated with the same.
Freight LTL/FTL Shipping Services
Global Hookah, Inc. is also able to meet the demand of its Business customers who desire a high volume shipment by utilizing freight LTL and FTL services a more cost effective approach than shipping multiple packages with UPS services. In the event your order was shipped using a freight option, Global Hookah, Inc. shall provide your Business with the applicable freight carrier and contact details on your attached invoice along with the details below of how to prepare for delivery of your Freight shipment. You may visit the carriers web site approximately 12 to 24 hours from the time we provide you with this information to track your order and determine the actual transit time and delivery date of your shipment.
Please note that you are not authorized to use any additional freight services such as lift gate delivery, residential delivery, appointment delivery, inside delivery, limited access delivery, etc. on this shipment unless it has been pre-arranged and confirmed in writing with our company. In the event you require such services and these services were not pre-arranged with our company you will incur additional fees associated with the same which are entirely your responsibility.
Freight LTL services and rates are based on a standard dock to dock service at commercial locations only. Unless you have pre-arranged in writing with Global Hookah, Inc. that you require additional services such as lift gate delivery, residential delivery, appointment delivery, inside delivery, or limited access delivery, the Freight LTL rate that you have been billed will reflect a standard dock to dock service at a commercial location. If you do not have a dock or forklift at your commercial location, then you are responsible for unloading the freight box by box from the truck. The freight driver is not responsible for assisting with unloading the freight off of the back of the truck. Be aware that in most instances, due to carrier liability from potential risk of injury, freight carriers typically will not permit you to unload your freight from the back of the truck if you do not have a standard dock or forklift, and will then require the use of the trucks liftgate for a surcharge. Be advised that Global Hookah, Inc. is not responsible for this added charge nor the circumstances surrounding the same with respect to the carrier. In the event your Business facility does not have a standard freight dock or a forklift, then it is your responsibility to advise our customer support team of this so we may arrange for this special accommodation at the time of your order. You are not permitted to refuse your shipment in the event the freight carrier requires your Business to utilize the liftgate to unload your freight and you are imposed a surcharge for this service. Be aware that by scheduling any special accommodations, including but not limited to liftgate service, inside delivery, limited access delivery, etc., at the time you place your order with Global Hookah, Inc., we are usually able to obtain the same at a discounted rate as opposed to on demand services at the time your merchandise is being delivered to you by the applicable freight carrier.
It is very important to track your freight shipment with the selected carrier listed above to determine the estimated delivery date. Freight LTL transit times usually do not come with a service guarantee unless pre-arranged in writing requesting a guaranteed transit time service at a premium surcharge. Therefore, you should take the opportunity to contact the freight carrier to determine what date and time frame your freight shipment will be delivered to your location. It is usually best to contact the freight carriers local service center between 7 AM and 9 AM in your local time zone on the day of delivery to determine the estimated delivery time frame for your shipment. If the freight carrier shows up to your location and the location is closed or there is no one to accept the freight shipment, you may be responsible for redelivery charges on your shipment which will be billed in addition to the shipping charges listed on the attached invoice. In the event your Business is not open and there is no one at your Business between the hours of 8:00AM to 5:00PM to receive your shipment, then it is imperative you contact the applicable freight carriers local service center to schedule a delivery appointment.
When the freight carrier arrives at your location, unless you have pre-arranged in writing with Global Hookah, Inc. that you require additional services such as lift gate delivery, residential delivery, appointment delivery, inside delivery, or limited access delivery, you should not use or sign off on these services even if the driver insists without prior communication and approval from Global Hookah, Inc. in writing. If you use these special services or acknowledge with your signature on both copies of the Freight Bill of Lading that any additional services were performed, Global Hookah, Inc. reserves the right to bill your account for these services. If you have any issues with your freight shipment or have any doubts regarding the Freight Bill of Lading at the time of delivery, do not sign the paperwork that the driver hands you and immediately contact Global Hookah, Inc. at 1-888-346-6524. You have the right to make the freight driver wait a few minutes while contacting Global Hookah, Inc. for clarification. By failing to contact Global Hookah, Inc. in the event any issue arises to seek clarification, you assume all liability for the outcome and Global Hookah, Inc. shall not be liable for any added charges associated with your decisions.
Listed below are the different special services that may be listed on the Freight Bill of Lading and these services should not be utilized without prior permission by Global Hookah, Inc. unless pre-arranged in writing and pre-paid for:
Lift Gate Delivery
If you use the lift gate located on the back of the freight truck to lower the freight to the ground to accomplish delivery of your shipment, then you have used a lift gate service. Do not use this service unless pre-arranged and pre-paid with Global Hookah, Inc. prior to shipping your order.
A Residential Delivery is defined as delivery to a location that is a home, including a Business operating out of a home. If you are having freight shipped to a residential address, then it is your responsibility to notify Global Hookah, Inc. in writing prior to placing your order to make sure that this service is pre-arranged and pre-paid for.
Freight LTL services are not guaranteed unless a guaranteed service is requested and pre-paid for. Therefore, freight carriers will deliver freight from morning to night during normal operating hours for most Businesses. If you require a specific time or time frame for your delivery, then it is your responsibility to notify Global Hookah, Inc. in writing prior to placing your order to make sure that this service is pre-arranged and pre-paid for.
When you request that the freight carrier deliver your freight to a position beyond the immediate adjacent unloading position, an additional charge applies. Do not use this service unless pre-arranged and pre-paid with Global Hookah, Inc. prior to shipping your order.
Limited Access Delivery
If your location does not have a dock, alley way, or easy access to parking for delivering your freight shipment, then your location may be classified as a limited access delivery point. This also applies to construction sites and to sites where additional security measures cause delays. If the freight driver marks on the Freight Bill of Lading that your location is a limited access delivery location, then it is your responsibility to immediately notify Global Hookah, Inc. using 1-888-346-6524 before signing the Bill of Lading.
The above services may be pre-arranged at a much lower rate than using these services on demand. Again, you may not use any special services listed above without prior permission by Global Hookah, Inc. unless pre-arranged in writing and pre-paid for.
It is also important to make sure that both the shipper copy and the consignee copy of the Freight Bill of Lading contain the same markings, signatures, or written information. Confirm the number of pallets, number of cases listed on the pallets, and that the shrink wrap is fully intact before signing off and releasing the freight to your location. If your freight shipment appears to have been tampered with and/or is damaged, immediately contact Global Hookah, Inc. using 1-888-346-6524 so our customer service team may properly guide you by dictating to you proper exception language to be notated identically on both copies of the Freight Bill of Lading. Before signing off on both copies of the Freight Bill of Lading, it is critical that you specifically notate the Freight Bill of Lading with the delivery exception(s) as to any issues you are claiming with your shipment, be it shortages, damages, etc. on both copies of the Freight Bill of Lading and have the driver initial next to the exception(s) noted as well as provide you or an authorized member of your companys initials adjacent to the drivers initials. You must also contact us immediately while the driver is there using 1-888-346-6524 so we may guide you through the process of properly documenting the applicable delivery exceptions to be notated identically on both copies of the Freight Bill of Lading. Be forewarned that if you fail to contact us and follow our specific guidance on listing the proper notation for any delivery exception(s) identically on both copies of the Freight Bill of Lading, you could forfeit your claim and be without recourse. Retain your copy of the Freight Bill of Lading as proof of the delivery exceptions noted within. It is also advised to utilize your surveillance capabilities or simply take some photographs and video to preserve the delivery exception you are noting if the shipment arrives in what appears to be tampered and/or damaged condition. We will need these photographs/video in order to properly investigate your potential claim.
Transit Times Approximate & Delays in Transit
**Please note that all transit times are approximate and derive from the shipping carrier. While Global Hookah, Inc. strives to promptly process and place your order in the hands of the applicable shipping carrier, we have no control over the actual transit time to the destination once the carrier is in possession of your order. Global Hookah, Inc. shall not be liable for carrier delays due to weather, holidays, breakdowns, or other circumstances beyond our control which result in a delay and causes your order to arrive beyond the estimated time frame listed nor shall Global Hookah, Inc. be liable to reimburse carrier fees for shipments which arrive beyond their estimated transit time frame. It is recommended and entirely your responsibility to place your order well in advance to potentially avoid any such shipping delays to your Business; however, even doing so there is no guarantee your shipment will not suffer a delay. Again, this is beyond the control of Global Hookah, Inc.
Cargo Insurance Recommended
**Please be aware that when shipping with Freight FTL/LTL services that the applicable carrier only maintains a limited insurance policy covering your shipment against loss. As per Global Hookah, Inc. Terms of Service, we are not responsible for loss occurring once your shipment has been delivered to and is in the possession of the applicable shipping carrier. It is your responsibility to determine if additional insurance coverage is required to insulate your merchandise against loss. Global Hookah, Inc. recommends that your Business procure and maintain an All Risk Cargo Insurance Policy to appropriately protect your merchandise from any potential losses which could occur while it is in the possession of the applicable shipping carrier. Global Hookah, Inc. hereby disclaims any and all responsibility with regard to your shipment once placed in the possession of the applicable shipping carrier.
BUSINESS RETURN, EXCHANGE & REPLACEMENT POLICIES:
Global Hookah, Inc. is dedicated to processing and shipping out your order quickly and accurately, and all orders must pass through multiple control checks to assure accuracy and quality. Global Hookah, Inc. strives for a 100% Satisfaction Goal with our Business customers. Unfortunately, there may be a time where a situation arises resulting in the need for action and our involvement. Communication is essential for this in order to fulfill our satisfaction goals to you if you feel we have failed to meet our 100% Satisfaction Goal. As part of our reasonable Terms of Service, it is important that our Business customer agrees to notify Global Hookah, Inc. of any shipment discrepancies, including but not limited to the following: invoice overcharges, incorrect prices, incorrect items, damaged items, shortages, overages, etc. within (5) five Business days from receipt of your merchandise. All discrepancies determined to be Global Hookah, Inc. fault will be credited or reshipped at our expense.
Any discrepancies reported beyond (5) five Business days will not be accepted unless you demonstrate extenuating circumstances applicable to your situation. Global Hookah, Inc. reserves in its sole discretion the right to honor discrepancies reported beyond the (5) five Business day term. Failure to report your discrepancy within (5) five Business days from the time of delivery may result in your claim being denied by the shipping carrier and our company. Once a support ticket is established with our customer service team, we will help you throughout the claims process to effectively coordinate the information we require in order to achieve the resolution of your inquiry. Please understand that damage claims do take time to process with the applicable shipping carrier, typically up to (180) one hundred eighty days, and we appreciate your patience and ongoing cooperation during this process.
Please understand that merely submitting a support ticket regarding incomplete, incorrect, defective, or damaged merchandise is only the first step and that we do require your continued cooperation throughout the claims process. Without your continued cooperation, your claim may be closed and otherwise denied for any unreasonable delay, lack of activity or responsiveness on your part. Do not ship your damaged item back to our facility at any time as we do have a clear procedure to follow and we shall not be responsible for any loss or further damages caused in doing so. During the claims process, it is critical that all merchandise that is the subject of a claim be retained by you until we notify you otherwise. Do not discard of any merchandise being claimed as damaged or defective. Global Hookah, Inc. may seek return of the merchandise you claim as being defective to our facility for further inspection and testing. Prematurely discarding merchandise that is being claimed as defective will result in the immediate denial of your claim. Once the claims process is complete we will expressly provide you with confirmation that the merchandise at issue may now be discarded. All applicable shipping charges for returning the item to our facility shall be the responsibility of the customer unless, in our sole discretion, we provide you with a pre-paid return label at our expense. Please understand that in most cases, the claims process is governed by applicable time limits outside of the control Global Hookah, Inc. and thus your timeliness in reporting any issues with your order are necessary as is your cooperation in processing the required claim. Your claim must be submitted in writing and either emailed to firstname.lastname@example.org and/or faxed to 305-402-2300. Global Hookah, Inc. will not accept notice of discrepancies made by telephone.
Only manufacturer defects or items damaged during shipping will be authorized for store credit. Please be aware that due to the regulation concerning the taxation of Tobacco, all sales are final and not eligible for return or exchange unless Global Hookah, Inc. failed to provide you with the correct brand, flavor, size and/or quantity of Tobacco. All returns must be accompanied by a return label that is provided by Global Hookah, Inc. in order to receive full credit or item replacement. Damaged and missing items must be reported within (5) five Business days of delivery. All returned items are subject to a 15% restocking fee and the customer will be responsible for any return shipping charges. Unauthorized returns will not be credited or reshipped.
Original Condition for Return
All merchandise being returned must be returned in new & unused resalable condition and include all original packaging materials, instructions and accessories. We will not issue partial credits. Any used, incomplete, or merchandise rendered damaged or defective by the customer while in their possession will not be accepted and will not be credited.
Global Hookah, Inc. reserves the right to cancel any quantity discounts and may modify the discounted bill so that it reflects the full wholesale purchase price for items on the invoice that are not returned.
All Sales on Warehouse Deals, Special Orders, Clearance or Discontinued Items are Final
Global Hookah, Inc. shall not accept returns of any Warehouse Deals, Special Orders, Clearance or Discontinued Items. All sales on these items are final.
Damages and Shortages
Any other discrepancies must be reported within (5) five Business days from receipt of your merchandise. All orders are inspected and must pass a rigorous quality control procedure performed by multiple personnel prior to departing our fulfillment center and placed in the possession of the applicable shipping carrier. If your shipment appears to have been opened, re-taped, or otherwise tampered with in any manner, you must keep the original boxes and file a claim with the applicable shipping carrier. If your order arrives in good condition, but contains damaged merchandise, shortages, or overages, please submit an email to email@example.com immediately to file a claim. If the fault for any damage or shortage falls on Global Hookah, Inc. we shall issue a credit or reship a replacement at our expense. In the case of an overage or incorrect merchandise, Global Hookah, Inc. will arrange for the return and shipping to our facility. Please be sure to protect the overage against loss until we are able to arrange for its return to our facility.

including but not limited to, telephone, electronic mail, facsimile, and text
messaging. Please understand that by opening and maintaining an account with
Global Hookah, Inc. that you, the customer, consent to receive
said communications. In order to comply with Federal and State
Guidelines, be advised that Global Hookah, Inc. Customer Service
Representative communication(s) shall solely contain transactional information
that is essential to your order, be it order and payment confirmations,
verification codes, password resets, two-factor authentication, account
activation, shipping and delivery notifications, and the like. At no time
shall Global Hookah, Inc. communicate advertising, marketing or
promotional information without first obtaining prior written consent in

DISPUTES, JURISDICTION & VENUE:
By opening a Business account with Global Hookah, Inc., the Business customer and personal guarantor authorized and selected by the Business client hereby consent to the following terms of service regarding disputes. Any dispute, controversy or claim arising out of or relating to the Global Hookah, Inc. Terms of Service, or the breach thereof (Dispute), shall be settled by binding arbitration, conducted on a confidential basis, under the then current Commercial Arbitration Rules of the American Arbitration Association (the Association) strictly in accordance with the terms of this Agreement and the substantive law of the State of North Carolina. The arbitration shall be held at a mutually agreeable location in Charlotte, Mecklenburg County, North Carolina, and conducted by one arbitrator chosen from a list of attorneys who are members of the Associations commercial arbitration panel, from a neutral geographic location, who is knowledgeable about the subject matter forming the basis for the Dispute and who has been engaged in the practice of law for a period of at least ten (10) years. If the parties cannot promptly, within (30) thirty days, agree on the selection of the arbitrator, the arbitrator will be chosen pursuant to Rule of the Commercial Arbitration Rules of the Association. The initial costs of the arbitration, including initial fees to be paid to the arbitrator, shall be initially shared equally by the parties to the Dispute. Each party shall bear the cost of preparing and presenting its case to the arbitrator; however, in any dispute brought by either party against the other party to enforce such partys rights or remedies under this Agreement, the prevailing party shall be entitled to be reimbursed by the other party for the prevailing partys reasonable attorneys fees, Arbitration costs and expenses otherwise incurred in pursuing and prosecuting such Dispute. The arbitrator shall issue his/her award and a brief description of the basis for the award in writing. The judgment upon the award rendered by the arbitrator may be entered and enforced in any court of competent jurisdiction. Neither party shall be precluded hereby from seeking provisional remedies in the courts of any jurisdiction including, but not limited to, temporary restraining orders and preliminary injunctions, to protect its rights and interests, but such shall not be sought as a means to avoid or stay arbitration. The parties agree that they have voluntarily agreed to arbitrate their disputes in accordance with the foregoing. The parties also agree that their dispute, the arbitration process, any evidence disclosed and or otherwise obtained during the same as well as the final judgment/decree by the arbitrator shall be confidential, the disclosure of which shall be actionable by either party should a breach of the same ensue. In the event of insolvency of the Business where no assets remain to otherwise resolve a judgment obtained by Global Hookah, Inc. against that Business, then the personal guarantor previously authorized by the Business shall promptly resolve the judgment in his/her personal capacity. In the event a dispute arises, the personal guarantor(s) shall be officially named as a party in any action thereunder. This personal guarantee shall remain in full force and effect and survives any declared Bankruptcy or application for Bankruptcy protections by the Business client.
