Disclaimer and Limitation of Liability as to Products Sold at SouthSmoke.com

All of SouthSmoke.com's products are guaranteed against defects for (72) seventy two hours from the date that the recipient receives the merchandise, but not to exceed seven (7) business days. Business days are defined as Monday through Friday. By ordering from SouthSmoke.com, you agree and certify under penalty of perjury and as per State and Federal guidelines that you are at least 21 years of age or older, and able to purchase tobacco and/or tobacco related products and/or tobacco accessories in your state.

By ordering from SouthSmoke.com, you also agree that SouthSmoke.com has up to 14 business days to ship your merchandise out of our facilities. Once an order has been shipped and/or tracking information has been received and provided from UPS, USPS, or FedEx, a customer cannot cancel and/or refuse delivery on their order without prior consent from SouthSmoke.com via email or US Mail. SouthSmoke.com reserves the right to charge a twenty five (15%) percent restocking fee on any order returned to our company after final inspections. SouthSmoke.com also reserves the right to charge any applicable fees that may have been associated with the order at the time of shipping if merchandise is returned to our facilities. Any merchandise returned to our facilities must be unused and in all original packaging. Any merchandise deemed used will be refused by SouthSmoke.com and will be returned to the customer at the customer's expense. If a Return Merchandise Authorization (RMA) was issued by SouthSmoke.com, the customer is responsible for paying the return fees associated with the UPS/USPS/FedEx standard rates guide if the merchandise is deemed used, not in its original condition, or is returned because the customer was not satisfied with the merchandise and SouthSmoke.com has concluded that there is nothing wrong with the merchandise received back in our facilities.

SouthSmoke.com, except as expressly stated herein, makes no representations or warranties, either express or implied, of any kind with respect to products sold on the SouthSmoke.com sites. Except as expressly stated herein, SouthSmoke.com expressly disclaims all warranties, express or implied, of any kind with respect to products sold on this site, including but not limited to, merchantability and fitness for a particular purpose. Please be aware that the SouthSmoke.com website shall solely be utilized for end consumer orders. SouthSmoke.com hereby disclaims any and all warranties / obligations under its Terms of Service with respect to orders placed by any third party business and / or reseller through the SouthSmoke.com website and shipped to a customer of that third party business and / or reseller.

You agree that the sole and exclusive maximum liability to SouthSmoke.com arising from any product sold on the SouthSmoke.com site shall be the price of the product ordered. In no event shall SouthSmoke.com, its directors, officers, employees or other representatives be liable for special, indirect, consequential, or punitive damages related to products sold.

SouthSmoke.com currently accepts the following payment methods: Credit/Debit Card via Visa, MasterCard, American Express & Discover. In the event of a chargeback or non-payment against SouthSmoke.com through our consumer or business channels, the account holder will be responsible for all fees regarding collections. These fees include, but are not limited to, the North Carolina Service charge, $30 chargeback fee issued by the credit/debit card issuer, all applicable collection agency fees incurred by SouthSmoke.com, any or all attorney fees and legal costs incurred, original shipping charges incurred by SouthSmoke.com, and return shipping charges incurred by SouthSmoke.com. In the event of non-payment, the customer will be responsible for the costs of the merchandise at the time of order.

All tobacco and tobacco related products and accessories sold at SouthSmoke.com are intended for legal tobacco smoking use by adults (21 years or older) only. Any other use of such products, by minors or for use with controlled substances is prohibited by and may constitute a violation of International, Federal, State, and/or Local Laws.

Typographical Errors

In the event a product is listed at an incorrect price or with incorrect information due to typographical error or error in pricing or product information received from our suppliers, SouthSmoke.com shall have the exclusive right to refuse or cancel any orders placed for product listed at the incorrect price. SouthSmoke.com shall have the right to refuse or cancel any such orders whether or not the order has been confirmed and your credit card charged. If your credit card has already been charged for the purchase and your order is canceled, SouthSmoke.com shall immediately issue a credit to your credit card account in the amount of the charge. Be aware that based on your agreement with your card issuer the charge may take several days or more to be credited back to your account and the funds otherwise released to you.

Promotions and Offers

Throughout the year, SouthSmoke.com may offer various promotional items, discounts, gift cards, or incentive codes (collectively promotion(s)) on our website and throughout our social media channels. Each promotion, be it a monetary discount or a redeemable physical item, is governed by strict qualifying terms. International Orders at SouthSmoke.com

SouthSmoke.com is happy to coordinate the shipping of our hookah products outside the United States to most countries and to APO/FPO addresses. However, deliveries to international locations outside the continental United States may require additional shipping charges. Furthermore, due to international regulations, SouthSmoke.com may refuse service on international orders from some countries. Only one international order may be in transit at any given time. Please wait until your order is delivered prior to placing a new order. We reserve the right to cancel a new order placed while an existing order is still in transit to its destination and yet to confirm as delivered.

Please be aware that our quotes for shipping outside the United States and Puerto Rico do not include any applicable duty, Value Added Taxes (VAT), or import consumption taxes. You will be required to pay the duty or VAT upon delivery of your merchandise. Due to import duty valuation adjustments and currency valuations, we are unable to provide an estimate for duty or VAT.

To determine shipping rates to your specific country, please register for an account at SouthSmoke.com and follow our simple step-by-step shopping checkout process. You will be provided with international shipping rates via the United States Postal Service to your country during the checkout process. SouthSmoke.com has chosen the United States Postal Service as our premier international shipping carrier to ensure that your merchandise is delivered in a timely fashion with minimal or no duties/taxes applied to your order.

Typical transit time for United States Postal Service First Class Mail International and Priority Mail International service is approximately 6 to 10 Business Days, not including customs processing time. Typical transit time for United States Postal Service Express Mail International service is approximately 5 to 7 Business Days, not including customs processing time. Typical customs clearance processing time is about 1 to 3 Business Days but may take longer depending on a variety of factors.

While we do ship to many international destinations it is very important that you first determine you are in fact permitted to import tobacco products or any other product we sell prior to placing your order. If you fail to make this determination and purchase products from our website that are prohibited from being imported to your country, and your order or any items contained therein are seized, or you face legal consequences as a result, SouthSmoke.com shall not be liable in any manner for your actions as you bear the risk of loss.

Taxes, Duties, and Importation Fees

SouthSmoke.com prides itself on compliance as we are a multinational company serving both the domestic and international communities. SouthSmoke.com customers are responsible for the payment of all applicable sales taxes, customs duties, import consumption taxes, Value Added Taxes (VAT), and similar taxes or fees (collectively, taxes and fees) imposed by your country, any government entity or collecting agency. You will be required to pay any assessed taxes and fees upon delivery of your merchandise. Due to import duty valuation adjustments and currency valuations, we are unable to provide an estimate for duty or VAT.

Each customer shall be solely responsible for all sales taxes, tobacco taxes, or other taxes, on orders shipped to any other state other than the State of North Carolina.

Order Cancellation Policy

SouthSmoke.com's goal is to provide the fastest possible service to its customers. In order to accomplish this goal, your order will begin to be processed shortly after it is received. We currently cannot guarantee that we will be able to cancel your order once we have commenced charging and submitting it for processing. If your order has not already been charged with your approved method of payment as placed with your order we should easily be able to cancel it; however, once your order has been charged it is being fulfilled and shipped, and we will not be able to cancel your order at that time.

We strongly recommend that all customers wishing to cancel an order do so within 30 minutes from the time your original order is placed during our normal business hours Monday-Friday 10:00 am - 6:00 pm EST by contacting our Customer Service Team at 1-888-577-6653. In the event you have submitted your order outside of our normal business hours then please submit an online support ticket.

In the event we are unable to cancel your order and you are interested in returning your hookah merchandise, you may return it in original and unused condition for a full refund of the purchase price. Shipping charges and any applicable restocking fees are not refundable. Please also be aware that Smoke Points Rewards for the returned item(s) will be forfeited.


Returns and Exchanges

Domestic Product Exchange Policy

SouthSmoke.com offers United States customers the ability to exchange unused hookah products ordered online.

When you shop at SouthSmoke.com, we want you to be completely satisfied. If for any reason you are not satisfied with your purchase or maybe you just ordered the incorrect item, color, or style, you may be able to exchange it for another hookah product offered at SouthSmoke.com. Remember, you are responsible for any and all applicable shipping charges associated with an exchange, including the original shipping charges, return shipping charges, and reshipping charges associated with your exchange. These charges are not refundable. The merchandise you wish to exchange must also be unused.

If you would like to exchange your hookah merchandise to SouthSmoke.com, you must submit an electronic inquiry via email or chat or by calling our Customer Service Team within (72) seventy two hours, but not to exceed (7) seven business days from the time your merchandise is deemed delivered by the designated shipping carrier. Due to OSHA Regulations and Policies, any item deemed disposable or any item that is used and/or opened may not be exchanged. Please be advised that we take every precaution in making sure that your gifts arrive in perfect condition.

Domestic Return Policy

If you would like to return your unopened/unused hookah merchandise to SouthSmoke.com, you must submit an electronic inquiry or phone call within seven business days from the time your merchandise is deemed delivered by the designated shipping carrier.

International Exchange and Return Policy

When you shop at SouthSmoke.com, we want you to be completely satisfied. If for any reason you are not satisfied with your purchase, you may contact our dedicated Customer Service Team for additional assistance.

Due to international regulations, international orders do not qualify for returns or exchanges with our company.

The original shipping charges that are applied to your order are not refundable. In the event that the actual shipping charges incurred to SouthSmoke.com by the carrier are greater than the shipping charges incurred by the customer, the customer will be responsible for the difference when merchandise is being returned. The customer hereby permits and authorizes SouthSmoke.com to process payment with the payment method utilized by the customer at the time the order was placed for the added difference in shipping charges. In the event that the customer received free shipping through a promotional offer, the customer will be responsible for all shipping costs incurred by SouthSmoke.com if the value of merchandise being returned allows the order value to fall below the value of which shipping is provided at no charge.

SouthSmoke.com may issue restocking fees of up to 15% of the merchandise value being returned if your return is associated with your package being opened and inspected by your customs or border services. Restocking fees also apply if your package is returned as a result of your package not being claimed or picked up at your postal services facility. SouthSmoke.com may also impose return shipping charges associated with any international order that is returned to our facilities due to your package being opened and inspected by your customs or border services. Return shipping charges may also apply if your package is returned as a result of your package not being claimed or picked up at your postal services facility.

International Customs Processing 

If your SouthSmoke.com order was inspected by your customs office and is subject to additional import taxes and fees, it is your responsibility to pay these charges assessed by your customs and border services office. Unfortunately, SouthSmoke.com has no control over which packages are inspected by customs and which packages are imposed additional tariffs by your customs office. In regards to customs clearance on International orders, SouthSmoke.com ships packages to international destinations on a daily basis. Most International orders that SouthSmoke.com processes and ships clear customs with little or no duties and no problems. SouthSmoke.com also does not offer refunds back to the original payment method provided which is consistent with our international ordering policies and procedures.

It is your responsibility to contact your local customs office to determine the different tariffs that your country may impose on imports depending on the merchandise ordered. If your current package is being held by your customs office, please review the different options available to you listed below for additional assistance with your package:

  • Claim Your Package From Your Customs Office - You may claim your package from the local customs office and pay any applicable taxes and fees that were imposed on your package.

  • Refuse Your Package and Receive a SouthSmoke.com Gift Card - You may contact your local customs office and refuse your package and any import duties/taxes. Your package will be returned to the SouthSmoke.com distribution and processing facility in the United States within approximately two to six weeks, depending on customs processing times. You may be subject to return shipping charges and a 15% restocking fee if the package is refused due to customs fees. Once your package arrives back, you may choose to have a SouthSmoke.com Gift Card emailed to you for the merchandise value associated with your returned order minus any applicable return shipping charges and restocking fees. This gift card may be used on future online orders placed at SouthSmoke.com and is typically good for up to two years from the date of issue. You may use this gift card on one order or on many orders over time until the entire value of the gift card is depleted, depending on your ordering needs. Please note that the original shipping charges will not be reimbursed and only the applicable merchandise value after any return shipping charges and restocking fees will be provided with the SouthSmoke.com Gift Card. Please also keep in mind that your Smoke Points balance may be adjusted due to your returned order.

    Be aware that in the unfortunate event your return shipping charges and the 15% restocking fee exceed the value of the merchandise being refused, then we will not be able to issue a SouthSmoke.com Gift Card as the remaining value of the refused merchandise would otherwise be negated by your return shipping charges and restocking fee. Thus, your only option would be to pay to re-ship your merchandise with the same risk of customs levying import and/or VAT or simply abandoning your order.

    SouthSmoke.com does not have any ability to control your country's laws regarding imports and your obligations thereunder. This is the unfortunate risk you assume when placing an international order with our company. Please be advised that attempting a chargeback for merchandise you have refused due to your country's customs levying an import duty and/or tax which you are unwilling to pay is a violation of our terms of service and not a justifiable method for resolving this issue with our company.

    Prior to placing an international order it is highly recommended you review our terms of service regarding international ordering and returns with our company and the issues you may face importing products to your applicable country so you are well informed of the various risks associated with the same.


Claims Procedures for Incomplete, Incorrect, Damaged, or Missing Merchandise

“What do I do if my order is incomplete, incorrect or damaged?”

Please be advised that we take every precaution in making sure that your order arrives in perfect condition. If your order is missing merchandise, incorrect, or damaged, please immediately submit an electronic inquiry via our Contact Us page. Damaged and/or missing merchandise must be reported to our company within (72) seventy two hours, but not to exceed (7) seven business days from the time of delivery to ensure that your cargo claim is processed and approved in a timely manner. Failure to report damaged and/or missing merchandise within (7) seven business days from the time of delivery may result in your cargo claim being denied by the shipping carrier and our company. Once a support request is established with our Customer Service Team, we will help you throughout the claims process to effectively coordinate the information we require in order to achieve the resolution of your inquiry.

Please understand that damage claims do take time to process with the applicable shipping carrier and we appreciate your patience and ongoing cooperation during this process. Please understand that merely submitting a support request regarding incomplete, incorrect, or damaged merchandise is only the first step and that we do require your continued cooperation throughout the claims process. Without your continued cooperation, your claim may be closed and otherwise denied for any unreasonable delay, lack of activity or responsiveness on your part. Do not ship your damaged item back to our facility at any time as we do have a clear procedure to follow and we shall not be responsible for any loss or further damages caused in doing so.

“What do I do if my order contains defective merchandise?”

SouthSmoke.com prides itself on its ability to effectively perform quality control checks on all merchandise it manufactures or otherwise receives from third party manufacturers to detect against and eliminate defective merchandise from being passed on to its customers. While we take every reasonable step to detect against and eliminate defective merchandise from the SouthSmoke.com inventory, in the unfortunate situation that your order contains merchandise that you feel to be defective, please immediately submit an electronic inquiry via our Contact Us page.

Defective merchandise must be reported to our company within (72) seventy two hours, but not to exceed (7) seven business days from the time of delivery to ensure that your claim is processed and approved in a timely manner. Failure to report defective merchandise within (72) seventy two hours, but not to exceed (7) seven business days may result in your claim being denied. SouthSmoke.com reserves the right at its sole discretion to either remedy, repair, replace the defective merchandise or provide store credit in the form of a SouthSmoke.com Electronic Gift Card for the defective merchandise.

SouthSmoke.com is not responsible for honoring return or reshipping charges associated with a defective merchandise claim unless we pre-approve the same in writing and provide a return shipping label to you. Please do not merely ship back the merchandise, but permit our experienced Customer Service Team to guide you through the process of determining if a replacement or store credit is necessary to remedy the situation. Please understand that merely submitting a support request regarding what you believe to be defective merchandise is only the first step and that we do require your continued cooperation throughout the claims process to determine if in fact the merchandise you received is defective. Without your continued cooperation, your claim may be closed and otherwise denied for any unreasonable delay, lack of activity or responsiveness on your part.

“What do I do with merchandise being claimed as defective once my claim has been submitted?”

During the claims process for merchandise being claimed to be defective, it is critical that all merchandise that is the subject of a claim be retained by you until we notify you otherwise. Do not discard any merchandise being claimed as defective. SouthSmoke.com may seek return of the merchandise you claim as being defective to our facility for further inspection and testing. Prematurely discarding merchandise which is being claimed as defective will result in the immediate denial of your claim. Once the claims process is complete we will expressly provide you with confirmation that the merchandise at issue may now be discarded. All applicable shipping charges for returning the item to our facility shall be the responsibility of the customer unless, in our sole discretion, we provide you with a prepaid return label at our expense.


Disputes, Jurisdiction, and Venue

By placing an order with SouthSmoke.com, the customer hereby consents to the following terms of service regarding disputes. Any dispute, controversy or claim arising out of or relating to the SouthSmoke.com Terms of Service, or the breach thereof (Dispute), shall be settled by binding arbitration, conducted on a confidential basis, under the then current Commercial Arbitration Rules of the American Arbitration Association (the Association) strictly in accordance with the terms of this Agreement and the substantive law of the State of North Carolina. The arbitration shall be held at a mutually agreeable location in Charlotte, Mecklenburg County, North Carolina, and conducted by one arbitrator chosen from a list of attorneys who are members of the Associations commercial arbitration panel, from a neutral geographic location, who is knowledgeable about the subject matter forming the basis for the Dispute and who has been engaged in the practice of law for a period of at least ten (10) years. If the parties cannot promptly, within (30) thirty days, agree on the selection of the arbitrator, the arbitrator will be chosen pursuant to Rule of the Commercial Arbitration Rules of the Association. The initial costs of the arbitration, including initial fees to be paid to the arbitrator, shall be initially shared equally by the parties to the Dispute. Each party shall bear the cost of preparing and presenting its case to the arbitrator; however, in any dispute brought by either party against the other party to enforce such party's rights or remedies under this Agreement, the prevailing party shall be entitled to be reimbursed by the other party for the prevailing party's reasonable attorneys fees, Arbitration costs and expenses otherwise incurred in pursuing and prosecuting such Dispute. The arbitrator shall issue his/her award and a brief description of the basis for the award in writing. The judgment upon the award rendered by the arbitrator may be entered and enforced in any court of competent jurisdiction. Neither party shall be precluded hereby from seeking provisional remedies in the courts of any jurisdiction including, but not limited to, temporary restraining orders and preliminary injunctions, to protect its rights and interests, but such shall not be sought as a means to avoid or stay arbitration. The parties agree that they have voluntarily agreed to arbitrate their disputes in accordance with the foregoing. The parties also agree that their dispute, the arbitration process, any evidence disclosed and or otherwise obtained during the same as well as the final judgment/decree by the arbitrator shall be confidential, the disclosure of which shall be actionable by either party should a breach of the same ensue.

Order Acceptance Policy

Your receipt of an electronic or other form of order confirmation does not signify our acceptance of your order, nor does it constitute confirmation of our offer to sell. SouthSmoke.com reserves the right at any time after receipt of your order to accept or decline your order for any reason. SouthSmoke.com reserves the right at any time after receipt of your order, without prior notice to you, to supply less than the quantity you ordered of any item. All orders placed over $250.00 (U.S.) must obtain pre-approval with an acceptable method of payment, as established by our credit and fraud avoidance department. We may require additional verifications or information before accepting any order.
